ÖZ

Bu çalışmanın amacı, Sosyal Güvenlik Kurumunun sigortalı veya hak sahiplerinin faydasına sunduğu tıbbi cihazlardan iade kapsamında değerlendirilerek işlem görenlere ilişkin olan mevzuatı inceleyerek analiz etmek, uygulamada karşılaşılan ve sigortalılar ve hak sahiplerine yük getiren veya Sosyal Güvenlik Kurumu açısından mali ve idari açıdan yönetim zorluklarına neden olan sorunları ortaya koymak ve son olarak söz konusu cihazların temini ve yönetimi açısından yeni bir bakış açısı getirmektir. Sosyal Güvenlik Kurumu tarafından finansmanı karşılanan farklı birçok sağlık hizmeti bulunduğu gibi, finansman yöntemleri de farklılık göstermektedir. Muayene ve tedavi işlemleri, ilaç, tıbbi malzeme, sıralı dağıtımlı ilaçlar vb. birçok farklı türde ürün ve hizmet, yine birçok farklı yöntemle geri ödeme sistemine konu olmaktadır. Çalışmamızda, Kurumca sigortalılara veya hak sahiplerine sağlanan tıbbi cihaz ve malzemeler ile söz konusu cihaz ve malzemelerin geri ödeme yöntemleri analiz edilecek ve Kurumca temini sağlanan tıbbi cihazlar arasında yer alan İade Kapsamındaki Tıbbi Cihazlara özgü geri ödeme yöntemi irdelenerek söz konusu yöntemin sigortalı ve hak sahipleri ile Kurum açısından sakıncaları üzerinde durulacaktır. Çalışmamızın nihayetinde ise İade Kapsamındaki Tıbbi Cihazlar için ayrı bir temin yöntemi önerilecektir.

ABSTRACT

The purpose of this study is to analyze the legislation regarding the medical devices that are evaluated within the scope of return of the medical devices offered by the Social Security Institution for the benefit of the insured or beneficiaries, and to reveal the points that are encountered in practice and that cause financial and administrative difficulties for the Social Security Institution and bring a new perspective in terms of procurement and management of said devices. Just as there are many different health services financed by the Social Security Institution, the financing methods also differ. Examination and treatment processes, medicine, medical equipment, sequential dispensing drugs, etc. Many different types of products and services are subject to reimbursement system with many different methods. In this context, in our study, the medical devices and materials provided by the Institution to the insured or the right holders and the reimbursement methods of the said devices and materials will be analyzed and the reimbursement method differentiating between the medical devices provided by the Institution and the said method and the insured and beneficiaries and the Institution. The drawbacks in terms of will be emphasized. At the end of our study, a separate procurement and payment method will be proposed for Returnable Medical Devices.
